On this day, the thirtieth day of April, 2020, We The People of the island of Kaua’i, in the state of Hawai’i, in the United States of America, do hereby officially petition the state and our governor David Y. Ige, the county and our mayor, Derek S.K. Kawakami, to demand the reopening of our schools, businesses, beaches and other public spaces such as state parks immediately.  The people of Kaua’i are suffering immensely every day that this unconstitutional, unnecessary lockdown continues.

• THERE IS NO PROOF THAT THIS LOCKDOWN HAS PRODUCED A DESIRABLE OUTCOME FOR THE ISLAND OF KAUA’I

As of this writing, our island of Kaua’i has seen a mere 21 cases of Covid-19, with only one of those requiring hospitalization, and a total of ZERO deaths. Many would like to believe that such numbers were ONLY possible due to the stringent “stay-at-home” measures taken to contain the virus, however this deduction is not based on anything more than an assumed correlation. What we have seen in other countries would prove that there is no way to make a definitive claim that these low numbers are a result of such mitigation. For example, countries, such as Taiwan and Sweden, which have not implemented any lockdown on their citizens have proven to have far less deaths than others who have imposed a mandatory “stay-at-home” order. These countries are now being applauded for having adopted what appears to be the most sensible and effective policy, resulting in nominal deaths, comparatively, and allowing for acquired herd immunity through mass exposure. While our statistical data is sound we also must consider the aspects of overall health, including psychological well being in addition to the devastating financial impacts not just throughout Hawai’i, but the entire world. Kaua’i, being a tourist-based economy, may never recover based on your decision to impose this unfounded lockdown!

Projections by the Imperial College London — which were later retracted because they were vastly exaggerated — were used to justify the shutdown of our country, affecting the lives of hundreds of millions of healthy Americans. The model’s authors went on to acknowledge that two-thirds of the people projected to die from COVID-19 would have died with or without the infection due to the vast prevalence of chronic disease and various comorbidities. As such, we believe the proportionate government response to COVID-19 must also be dramatically different than what is currently in effect. However, Dr. Anthony Fauci and Dr. Deborah Birx have both continued to push a certain narrative regardless of emerging new scientific data that would indicate a much different approach for maximum effectiveness. In the United States, we have not seen the millions of deaths initially projected and the current numbers that we do have are now questionable as we have become aware that not only is the testing itself inaccurate, but that doctors are being coerced to label deaths as COVID-19 regardless of other contributing factors. • THE OFFICIAL DEATH COUNT IS BEING MANIPULATED

It’s extremely troubling that data upon which life-and-death decisions are being made is inaccurate and methodologically flawed. Both the US health statistics agency and the World Health Organization have announced that the certification of “deaths by COVID-19” requires zero proof that the virus is the underlying cause of death. As a result, the official death statistics attributed to COVID-19 do not require cases to be positively confirmed through virus testing. Merely “suspected” cases of COVID- 19 are being included in the official numbers. In addition to this disturbing discovery we have also learned that the method of testing for Covid-19 has allowed for serious inaccuracy in determining “confirmed cases”. Concerning the use of PCR testing, the Centers for Disease Control has revealed that, “Detection of viral RNA may not indicate the presence of infectious virus or that 2019-nCoV is the causative agent for clinical symptoms.” This means a positive test doesn’t guarantee that the COVID-19 virus is causing infection at all and the virus might not be in the patient’s body whatsoever. • NEW SCIENTIFIC DATA PROVES SEVERITY OF COVID-19 IS EXAGGERATED

In Germany and the Netherlands, as well as California, serology studies were conducted to determine how many people have already been infected with the coronavirus and the estimates shed new light on the true severity of this virus. A survey done in Silicon Valley has proven that the true number of coronavirus infections appear to be 50 to 85 times higher than the number of reported cases. The survey conducted in Los Angeles county shows that 28 to 55 times more people were infected than was originally counted. These findings bring the mortality rate down to numbers which parallel your average seasonal flu. Another study by Dr. Justin Silverman estimates that there were 8.7 million coronavirus infections between March 8 and March 28, which isn’t surprising since testing cannot single out COVID-19 from other coronaviruses. • THE CURE IS BEING WITHHELD

In addition to the previous stated facts, there has also been no mention of the reality that multiple safe and effective treatments exist that can be used to combat any further instances of infection among the population. When used early the combination of hydroxychloroquine, azithromycin and zinc sulfate has proven to be safe and effective in treating patients. Thousands have recovered under this protocol with many being released from the hospital within 7 days. The first clinical study that showed that chloroquine is an effective therapy for treating COVID-19 is dated as far back as August 22, 2005. Recent clinical studies show the above-mentioned protocol using hydroxychloroquine is 100% effective for all patients when administered at the onset of symptoms, yet Dr. Anthony Fauci has refused to order doctors to use the protocol. Clinical trials in France have proven the treatment to be 100% safe and effective. More recent comprehensive, in depth trials within the U.S. now concur with the results out of France but no mention of this finding has been made. Public health policies are not intended to, nor will they ever be able to, provide individual or collective health. Public health policies have a proper role in society to shape a landscape conducive to achieving health: clean air; clean water; properly functioning sanitation systems; solid infrastructure; and education and resources on hygiene, nutrition and food preservation standards. It’s not the government’s role to guarantee health or to privilege certain lives over others. It is the government’s role to protect voters’ fundamental freedoms, including the freedom to worship and to provide for their families, without state interference.  We have also taken notice of the 17 pages of the latest proclamation that were dedicated to the suspension of Hawai’i Revised Statutes chapters. • TRESPASSES ON OUR CONSTITUTIONAL RIGHTS

As elected public officers you were asked to affirm an oath to support and defend the Constitution of the United States of America, and the Constitution of the State of Hawai’i. Closing all schools and public spaces; closing all “non-essential” businesses; mandating that healthy, law-abiding citizens stay at home; and imposing other extreme measures has created widespread devastation while completely trampling the rights of the people. Article 1, Section 8 of the Hawai’i State Constitution declares: No citizen shall be disfranchised, or deprived of any of the rights or privileges secured to other citizens, unless by the law of the land. The discriminatory act of allowing only select businesses to operate is a direct violation of this article. The forced closure of a private small business is in effect an illegal seizure of property without due process of law, and trespasses on our right to be secure in our persons, houses, papers and effects under Article 1, Section 7. Being jailed or issued a $5,000 fine for standing on a beach may be considered an excessive fine and a form of cruel and unusual punishment in violation of Article 1, Section 12. Due process of law is the process which all parties must obey in order to have actual law, justice, and civility. It is the law of nature and GOD. It has no preconceived notions of “for your own safety” or “the good of society“. The Constitution is the supreme, paramount law that can never be superseded by any so-called “emergency”.
